To obstruct potential criminal prosecution in the event of the planned estate fraud being exposed, Dr. Ernst Höfer, in the text of the forged will attributed to Lydia Wagner as the supposed sole heir, identified his accomplice, Brigitte Wagner (formerly married as Fuentefria), who resides in Spain.

Brigitte Wagner is merely the stepdaughter of the deceased Lydia Wagner from her first marriage to her spouse, Dr. Hanns Wagner.

As a consequence of their jointly damaging actions, the substantially incomplete estate of the deceased Lydia Wagner was unjustly awarded to Brigitte Wagner, an Austrian citizen residing in Spain.

For financial reasons, Brigitte Wagner married the Spanish tourism and nightclub industry magnate, DON ENRIQUE FUENTEFRIA ARNIJAS. In the subsequent divorce battle instigated by Brigitte Wagner, she sought exorbitant financial claims and maintenance demands, aiming to fund her loss-making horse stud and the breeding of top German sport horses in Spain in complete independence through coercion.

Due to her relentless pursuit, her husband depleted his entire fortune to Africa and was compelled to declare bankruptcy for his extensive tourism company, “VIAJES CELIMAR; SOCIEDAD ANONIMA,” a Spanish joint-stock company, in June 1992. During the divorce dispute, the first defendant was assigned joint liability by her husband for the future bankruptcy debts of his contentious enterprise, “Viajes Celimar SA.”

Following this financially disastrous divorce and preceding the passing of Mrs. Lydia Wagner in 1993, Brigitte Wagner was consequently burdened with substantial debt.

Immediately after the bankruptcy filing for “VIAJES CELIMAR SA” in 1992, the business banks of Don Enrique and Brigitte Wagner-Fuentefria initiated the partial repayment of outstanding mortgage loans through the forced auction of their properties in Spain.

Given this context, known to the deceased, Lydia Wagner, it is inconceivable that Lydia Wagner would have appointed Brigitte Wagner as the sole heir in a genuine will. Lydia Wagner would have been aware that her entire estate would be claimed by Brigitte Wagner’s Spanish creditors, rendering such a provision ineffective.

Brigitte Wagner was well-suited to be used as a Spanish alibi heir by Dr. Ernst Höfer in the forged will. Dr. Ernst Höfer and his deceased mother had amassed significant amounts of undeclared rental income as black money. Only with this black money from Dr. Ernst Höfer and his mother, despite her official over-indebtedness, could Brigitte Wagner establish her equestrian hobby at the Yeguada Aristos stud for top German sport horses in Spain and finance the construction of an equestrian facility in Riudarenas for her daughter Noelia Noe Fuentefria-Wagner.

The only plausible explanation is that Brigitte Wagner’s ownership shares in Lydia Wagner’s properties were settled by Dr. Ernst Höfer through these black money payments, in the only advantageous form for Brigitte Wagner.

The first defendant has renamed her Yeguada Aristos stud, located at E-17421 – RIUDARENES (Girona) Ctra. de Santa Coloma, km. 4, as Yeguada Mas Caldes to obscure its identity. It is now managed by her collaborating daughter, Noelia (alias Noe) Fuentefria-Wagner.

As an evident outcome of cooperation with Dr. Ernst Höfer, Brigitte Wagner could retain and expand this private property spanning 120,000m2 exclusively for horse pastures after 1993. Currently, it features 25 horse stalls, one dressage arena measuring 25 x 65m, another dressage arena measuring 20 x 40m, and a vaulting area, among other facilities.

The apparent success of their unscrupulous actions in maintaining their equestrian hobby seems to have emboldened Brigitte Wagner and her daughter Noelia Fuenterfria (alias: Noe Fuentefria) to engage in further damaging actions.

Coincidentally discovered, concerned relatives of Noe Fuentefria’s last or penultimate husband collected information about the first defendant and her daughter in 2020 and published it on Facebook under the profile Centro Ecuestre Mas Caldes at https://www.facebook.com/profile.php?id=100069097516664.

In this content, the then-husband of Brigitte Wagner’s daughter, who hailed from a wealthy Indian family, is pitied as the “next potential victim,” and a comment is made regarding the image of these two women: Quoting,

“The façade of a good person often hides the deepest abyss.”

The plaintiff believes that the tampered gasoline line in his car in Zell am See and the three arson attacks on his temporary shelter in 1100 Vienna, Eckertgasse 36, were orchestrated by Brigitte Wagner, utilizing the connections of her deceased ex-husband. However, no evidence has been presented so far to substantiate this suspicion.

Only after the original plan of Dr. Ernst Höfer and his mother to establish the disqualification of their son – even after attacking Lydia Wagner’s unborn grandchild – failed to materialize, did Dr. Ernst Höfer proceed with his alternative plan of directly forging the will and isolating and causing the death of Lydia Wagner through his medical malpractice.

Following the inheritance resulting from the estate of Lydia Wagner and Elisabeth Höfer’s father, Mr. Alois Wendl, shared equally in Zell am See in 1973, Elisabeth Höfer and Lydia Wagner had the same financial foundation.

Dr. Hanns Wagner, Lydia Wagner’s husband, earned significantly higher income for decades as the managing director of Wiener Holding and Bauring Wien compared to Dr. Höfer’s father, who worked as a teacher in Zell am See.

Under these circumstances, Dr. Ernst Höfer and his deceased mother could never have acquired their present real estate holdings without the financial contribution of Lydia Wagner.

Dr. Ernst Höfer and his mother declined to provide any explanation regarding the whereabouts of Lydia Wagner’s entire estate after having composed and submitted a fraudulent estate inventory for the deceitful handling of Lydia Wagner’s estate after her death.
